Almost all of the legal talent agencies that are licensed and bonded with the state use a Division of Labor Standards and Enforcement approved contract that appears to be exclusive. So many of the performers that are unhappy with their agent are told they cant leave until their contract is up.
I get a lot of phone calls from performers looking to get out of their agency's contract.

If the girl is in a contract with an agent to make money, the agent gets his cut. If someone contacts the girl directly about shooting a scene, and the girl says yes, so long as the agent gets his cut, what's the problem? Everyone is entitled to make a living, and the agent can't tell the girls who they can or can't work with, right? If he did tell the girl, 'You can't work with Jackie Fuckface because I don't like him.', isn't that breach of contract?
I'm probably oversimplifying things, I know, I just don't understand all this drama over agents. To the best of my knowledge the most an agent can charge anyone is 15%, and if he's actively preventing a girl from getting work because of his own agenda, then he's automatically in breach.
I could be entirely full of shit on those points though. most of what I know about contract law comes from what I researched when I was looking for an agent of my own. (A writing agent, not a porn agent. You guys do not want to see me naked.)

ANY contract that calls for a person to work in unsafe and hazardous conditions is unenforceable. California law regarding blood borne pathogen exposure, like it or not, apply to the adult industry. The standard "Labor Board" contract does not allow for working in unsafe conditions. On shelley lubens website there used to be(it might still be there) a 'notification' form tos send to an agency in order to break your contract. Dont let any INDUSTRY sawyer tell you that you are sutck in a contradct that calls for you to work in unsafe conditions. It is simply not true.
The brooke ashley workers comp case settled all of this last year.

The problem you have is that the contract will not call for the performer to work in a unsafe environment -- the producer will. Privity of contract is between the performer and the agent. Thus, unless the agent forces the performer to work in an unsafe environment, she cannot not unilaterally void her contract. She will still have to prove she was forced to work under unsafe conditions at a hearing.
What I will say is that if an agent forces a performer to do a scene that she opts not to complete because of her concern for her health or safety, (ie., the male talent has an obvious infection) that agent can lose that performer as well as his/her agency license if the Labor Board found the agents behavior to be egregious.
And the last time I checked Shelly Lubben was a former PW and hadnt graduated from law school. She probably shouldnt be giving legal advice since it may be considered to be practicing law without a license by the State Bar of California. So if you know Ms. Lubben personally, you may want to tell her to stick to saving souls - at least that doesnt require 7 yrs of education and bar exam.

The agent knows BEFOREHAND the situation,(no comdoms,no blood borne pathogen protection) the perfomer is to work under. Once an agent sends a performer to a shoot that he knows is illegal, the performer will have no problem having any "contract" with that agent voided. It is common knowledge that you cannot 'agree' to violate the law. It is the agent who negotioates with the producer/director on behalf of his client(performer). The agent knows what the situation will be. Or the agent could lie and say he didnt know what was going on, in which case, he aint much of an agent.
A vast majority of porn performer/porn agent "contracts' are not worth the paper they are prited on.

The contract is for the agent to procure LEGAL work for the performer. ANY job that requires someone to work in violation of OSHA regulations is not legal. Because the agent negotiates beforehand and knows the work requires violation of OSHA regulations the 'conrtact' is worthless.

It's ranked in the lowest tier of the US News and World Report law school rankings, but that survey is generally bullshit. What that usually means is that a law school like Whittier has relatively open admissions (elitist lawyers and judges value those schools which wouldn't let them in again), and then works its students hard to make good lawyers out of them. Those of us from top law schools dismiss the Whittier crowd at our peril.
According to WLS's website, 83% of its graduates passed the California bar the first time. My school's record is about 95%, which is not all that much better when you really think about it. The California bar is hard.
What I don't understand is how Fattorosi spent $250,000 at Whittier, unless he's counting the money he wasted going to American University. Whittier's tuition is $30K and room & board $11K. Shit, dude, if you're going to go to an average (or below-average) school, go to a cheap one. State colleges offer great value in this way.
As for Vanessa Blue, I've rubbed one out many a day while high as a kite, imagining her choking down my man-chowder.

Sure I wish I could have gone to a top ranked law school, but my father died after a long drawn out battle with cancer in my junior/senior year of college. I left school to take care of him and it killed my GPA and I had to settle for Whittier. I will take private over public all day long...

Don't make too much of bar exam rates. The bar exam generally tests state law. Some schools focus solely on that and get good pass rates. Other school put more emphasis on federal and law for multinational companies. A college roommate of mine went into multinational M&A after graduating and said that virtually none of his time in law school applied to the state bar exam...
My practice is corporate practice with an international focus and includes a large M&A component. This is on target, of course, but neglects the fact that what Fattorosi does is closer to "real lawyering" than what I do. I'm a generalized business consultant, really -- never seen the inside of a courtroom except for my own arraignment, and that's the way I plan to keep it!

Whittier has horrible passage rates... however, I didnt think that bar was really that difficult. But that was 12 yrs ago, I know the bar examiners have recently cranked it up and its getting more difficult. Even the grads from the top ranked schools arent passing on the first go-around now.
As for "real lawyering" in this industry... I have the utmost respect for Paul Cambria, Jeff Douglas, Alan Gelbard, Greg Piccionelli, Louis Sirkin, Clyde DeWitt, Larry Walters and all of the attorneys that defend First Amendment rights. Defending the Constitution as they do is something I do aspire to. We are in the process of filing/litigating our first, First Amendment claim. It is a steep learning curve though.
