Brian Surewood Charged With Attempted Murder

LOS ANGELES — Doctors said Wednesday that a 4-year-old hospitalized in critical condition may not survive after a "road rage" incident on Tuesday, according to police.
"The 4-year-old child is in extremely grave condition. We don’t even know if the child is going to make it. Doctors are very skeptical on that. They’re doing everything they can, but it does not look good for the 4-year-old," Capt. Ronald Marbrey of the LAPD.
The child’s 2½-month-old sibling and 31-year-old mother, all natives of India, were also hospitalized Tuesday, KNBC’s Robert Kovacik reported.
The crash, which was originally blamed on street racing, occurred at 3:12 p.m. at 17119 W. Sherman Way, between Balboa Boulevard and Louise Avenue, at 3:12 p.m. Tuesday, said Ron Myers of the Los Angeles Fire Department.
"Witnesses tell us that two individuals were driving at a high rate of speed westbound, here, on Sherman Way. It appeared to witnesses that they were jockeying for position," Marbrey said.
Marbrey said witnesses said the vehicles were traveling between 50 mph and 90 mph.
"They were cutting each other off," Marbrey said. "At one point further down the roadway, the red Camaro slammed on his brakes and the black Nissan barely missed colliding with him."
"Further down the road, here at Amestoy (Avenue), the red Camaro applied the brakes hard, the black Nissan attempted to avoid a collision and swerved to the right, and collided with a silver Daewoo," Marbrey said.
Marbrey said that the Daewoo slammed into the family, pinning them against a black Honda Civic.
Marbrey said the mother will probably lose one leg. Marbrey said her other leg was also severely crushed.
The infant suffered severe scrapes and injuries, according to Marbrey.
"That child, according to witnesses, was launched into the air and slammed against a tree. This is the tragedy of this incident, and this will impact this family. The father is totally distraught. He’s overwhelmed by this incident. It’ll impact this family for years and years to come," Marbrey said.
Police said the driver of the Nissan, 19-year-old Armando Ayon, of Pacoima, and the driver of the Camaro, 44-year-old Brian Barnes, of Northridge, have been arrested and charged with attempted murder.
If the 4-year-old dies, the pair would be charged with murder, Kovacik reported.
"This incident did not have to happen. That’s the tragedy of it," Marbrey said.
The crash occurred one day after a street race that resulted in a fiery crash that killed a woman and her two children in El Monte.

How can they be charged with attempted murder? I'm no porn-message-board-fake-lawyer or anything, but doesn't murder have to be premeditated and have a motive? Wouldn't this be involuntary vehicular manslaughter or something like that?

This must be one of those reactionary "get tough on _____" laws passed EVERYWHERE recently. I remember that if a child killed another child he/she was rarely tried as and adult. Now it’s as common as herpes in XPT moderators. I guess it should be vehicular manslaughter. Evidently local citizens and law makers have decided that if a person is willfully engaging in an activity as inherently reckless as street racing then they are premeditating killing somebody when an accident happens.
He deserves what ever he gets. Those people he hurt certainly didn't deserve what they are suffering though.

While part of me thinks this wave of Draconian reactions is scary; incidences like these sway me in the other direction.
You know Vince (I look like Sam Kennison) Neil killed a guy while driving drunk. Last I checked he still drinks and drives.

Perhaps Mr. Fattorosi esq. can illuminate us (except that he's also Brian's lawyer), but I believe that if someone dies whilst you are committing a felony it increases the charge from manslaughter to murder.
Assuming that street racing is a felony, then that's what you got.
Same shit if you accidentally kill the person you're kidnapping.

I'm no lawyer either, but the police and politicians here have been trying to come down hard on street racers for the past year. There has been tough talk of charges of murder should any innocents be killed because of racing. Whether or not it sticks is another question. Vehicular manslaughter sounds reasonable to me.
An aside; with Surewood on his way to jail, Rod Fontana preaching to the converted, and Lockwood tucked safely away in Spain I just may start buying movies again.

the attempted murder charge is obscene!
isnt it california law that a child should use a car seat or booster seat until the age of 6 or weighs more than 60 lbs??? if the child was properly secured inside the car, then i find it strange that the child was ejected from the car and hit a tree.
if the child was not in a car seat, then i find it negligent on behalf of the mother.

The victims were pedestrians, getting in or out of their car.
This is a tragedy for all involved. Brian's a very nice guy.
This has also now been deemed a road-rage incident and not street racing.

understandable...
i just watched the interview on knbc.com. the mother was getting out of her car, while holding her infant child, and had the 4 year old next to her. when you have access from a car onto a sidewalk or non traffic area, why dont you exit that way? why in the hell would you get your young children out of the drivers side of the car and put them into possible oncoming traffic? STUPID STUPID STUPID!!
it was stupid for brian to play stupid street games...road rage, street racing...whatever. he should be held responsible for his actions. sorry brian, you gotta bite the bullet this time hun!

the family was behind their car near the trunk unloading groceries. they were crushed when the 19 year old driver's car swerved to avoid surewood and hit the car parked behind theirs and squashed them between the two parked cars.

Actually, VJ, it's preetty clear. CC 187 says murder is the unlawful killing of another human with malice aforethought. CC 188 says malice can be implied, "When no considerable provocation appears." Vehicles are considered "destructive devices." So if you're road-raging with another guy, you're already committing one crime. If you kill somebody while commiting another crime, you've committed first degree murder.

true. i just find it crazy! a friend of mine was in a similar type accident; the four passengers she was carrying ended up dead as a result of the accident (all under the age of 18). she was charged with vehicular homicide and served no jail time.
